The Official Rules of the Fishtoberfest Photo & Video Contest:
ELIGIBILITY
The Fishtoberfest Photo & Video Contest (“Fishtoberfest Contest”) is open only to legal residents of the United States and who are at least eighteen (18) years old. Parents or legal guardians are invited to submit entries on behalf of minors less than eighteen (18) years old.
PRESENTERS
The Fishtoberfest Photo and Video Contest is presented by WorldCast Anglers, Jackson Hole Trout Unlimited and Teton Valley Trout Unlimited. This contest is in no way sponsored by, endorsed by, administered by, or associated with, Facebook, Instagram, Vimeo, Youtube or any other media outlet.
ENTRY PERIOD
The Fishtoberfest Contest entry period begins at 12:00am MST on June 20th, 2016 and ends at 11:59pm MST on October 9th, 2016 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. The WorldCast Anglers fly shop front computer is the official time-keeping device for the Fishtoberfest Contest.
WHAT TO ENTER
“Fishtoberfest Photo & Video Contest”: Enter a photo or short video celebrating fly fishing in the state of Wyoming and Idaho for a chance to win one of our fantastic prizes. Final entries will be shown at the Fishtoberfest celebration- October 27th, 2016 at the Q Roadhouse. Winners will be selected via online voting at WorldCastAnglers.com. The finalist photos and videos will be displayed at the event
You are encouraged to learn more about the contest by visiting WorldCast Anglers or Jackson Hole Trout Unlimited and Teton Valley Trout Unlimiteds’ websites. To ensure eligibility all photographs and videos should be taken within the state boundaries of Wyoming or Idaho and should accurately reflect the subject matter and the scene as it appeared. Photos and videos that have been digitally altered beyond standard optimization (removal of dust, cropping, reasonable adjustments to exposure, color and contrast, etc.) may be disqualified.
HOW TO ENTER
All entries must be submitted to fishtoberfest@gmail.com by 11:59pm MST on October 9th, 2016. The online voting process begins on October 11th, 2016 at 12:01am MST and ends on October 20th at 12:00am MST. Finalist will be announced on October 24th, 2016. The top 5 photos from each category and top 5 videos will be displayed at Fishtoberfest on October 27th, 2016 at the Q Roadhouse. Winners will be announced at the event.
Photo entries:
Entries should be emailed to fishtoberfest@gmail.com with “Fishtoberfest Photo Contest” in the subject line by 11:59pm MST on October 9th, 2016. Please make sure the total files are under 8MB. If your email is returned to you as unsent, try lowering the file size of your image. A total of 25 photos for each category will be displayed for voting. The Fishtoberfest Selection Committee will choose the top 25 photos for each category.
The file name of your entry must have your last name, first name and test that corresponds to the photo description (smithjennifersnakeriver or smithjennifercutthroattrout).
The Categories for entries are: (1) Fly Fishing Action or Landscape and (2) Fish Species specific (i.e. Fish Skin, Fish Face, specific fish features). There is no limit on the number of entries per person. Each entry must comply with the following requirements:
Images may originate in any format so long as they are submitted electronically in a .jpeg, .jpg or .tiff format for photo uploads. Higher resolution files of at least 240 or higher dpi/ppi will be requested should an entry be preselected to be awarded a prize or an honorable mention. Multiple exposures that have been combined to produce a single “High Dynamic Range” photo are acceptable.
You must not infringe on the rights of any other photographer, videographer, private landowner, or person, or submit images that involve the willful harassment of wildlife or damage to the environment. Excessive “Grin and Grip” photos harming fish are not welcome. Entries may not be watermarked. Photographs must have been taken within two (2) years before the date of entry.
Entries should include the following information:
-Name of Photographer
-Phone Number
-Email Address
-Mailing Address
-Specific Location of photo (i.e. Lewis River, Yellowstone National Park)
-Detailed caption of subject matter
Previously published material for which non-exclusive rights were granted may be entered as long as you still maintain the right to grant Fishtoberfest a license (see “Your Rights” below). You must be able to disclose when and where the photo or video appeared previously to the Fishtoberfest planning committee upon request.
Final photos will be on display at Fishtoberfest on October 27th at the Q Roadhouse. Those photos will be raffled off and all proceeds will go to Jackson Hole and Teton Valley Trout Unlimited.
If you choose to include people in your submission, you are responsible for obtaining the necessary releases from the individuals depicted, and must be able to provide copies of those releases to the Fishtoberfest Planning Committee upon request. The Fishtoberfest Planning Committee reserves the right to examine the original photograph/source material in order to confirm compliance with these rules.
Video entries:
Entries should be emailed to fishtoberfest@gmail.com with “Fishtoberfest Video Contest” in the subject line. Please include a private YouTube or Vimeo link to your film by 11:59pm MST on October 9th, 2016. There is no limit on the number of entries per person. A total of 10 videos will be displayed for voting. The Fishtoberfest Selection Committee will choose the top 10 videos for each category.
Film entries must follow the guidelines below:
-6 minute maximum run time – including titles and credits
-Film must be Titled and contain that title somewhere in the opening credits
-Must portray fly fishing within the state boundaries of Wyoming or Idaho
-Any species of fish may be included
-Must contain no copyrighted material without permission
-Must be edited (no uncut video) and have a mixed sound track
Entries should include the following information:
-Name of Producer
-Phone Number
-Email Address
-Mailing Address
-Specific Location(s) of video (i.e. Lewis River, Yellowstone National Park)
-Detailed caption of subject matter

You cannot win a prize unless you comply with all requirements in these Official Rules. The Fishtoberfst Planning Committee reserves the right to refuse or reject any entry or winner based on their discretion.
JUDGING

POTENTIAL WINNER REQUIREMENTS
A potential winner may be required to verify eligibility by October 26th, 2016. If a potential winner fails to verify eligibility on time, an alternate winner with the next highest amount of votes may be selected in his/her place. Only three (3) alternate potential winners shall be contacted per category.
The Fishtoberfest Planning Committee reserves the right, in its sole and absolute discretion, to determine the eligibility of entrants and winners and will at any time disqualify entries that do not act in the spirit of the contest.

All grand prize winners must complete and return an IRS W-9 form to the Jackson Hole Trout Unlimited prior to receiving their prize. All winners are responsible for paying any applicable income taxes associated with their prize winnings and any and all other costs and expenses not listed above. Any prize details not specified above will be determined by the Fishtoberfest Planning Committee in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Fishtoberfest Planning Committee reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by the Fishtoberfest Planning Committee in its sole discretion.
YOUR RIGHTS
Your photo and video submissions help the Jackson Hole Trout Unlimited and Teton Valley Trout Unlimited preserve, protect, restore and reconnect our coldwater fisheries and water systems in the greater Jackson Hole region. Thank you for your participation. In registering for this photo contest, you have accepted all rules and requirements and understand that the Fishtoberfest Planning Committee has the right to use all submitted photos in any future media, online, and print materials as outlined below.
You will retain copyright and ownership rights to any photograph or video you submit.
If you submit a photo or video to enter the Fishtoberfest Photo and Video Contest, you grant WorldCast Anglers, Jackson Hole Trout Unlimited and Teton Valley Trout Unlimited the nonexclusive right to:
-Display the photo or video on the WorldCast Anglers, Jackson Hole Trout Unlimited or Teton Valley Trout Unlimited website for up to two years (October 27th, 2018).
-Display the photo or video on the WorldCast Anglers, Jackson Hole Trout Unlimited or Teton Valley Trout Unlimited Facebook, Instagram, Google + or Twitter social media channels for up to two years (October 27th, 2018).
-Allow third-parties to share the photo or video on their social media platforms.
If your photo or video is formally honored by the competition as a winner, 2nd place or 3rd place you grant the Fishtoberfest Planning Committee the nonexclusive right, in perpetuity, to use the photo or video on the Internet and in Social Media for future marketing of Fishtoberfest event for the lifetime of the event.
GENERAL CONDITIONS
In the event that the operation, security, or administration of the Fishtoberfest Photo and Video Contest is impaired in any way, The Fishtoberfest Planning Committee may, in its sole discretion, either: (a) suspend the Fishtoberfest Photo and Video Contest to address the impairment and then resume Fishtoberfest Photo and Video Contest; or (b) award the prize(s) from among the eligible entries received up to the time of the impairment. The Fishtoberfest Planning Committee reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Fishtoberfest Photo and Video Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. The Fishtoberfest Planning Commitee’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. The Fishtoberfest Photo and Video Contest is subject to federal, state, and local laws and regulations and is void where prohibited.
RELEASE AND LIMITATIONS OF LIABILITY
By entering, you agree to release and hold harmless WorldCast Anglers, Jackson Hole Trout Unlimited, Teton Valley Trout Unlimited, Instagram, Facebook, Youtube, Vimeo, Twitter, Google + and their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Fishtoberfest Photo and Video Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Fishtoberfest Photo and Video Contest; (b) technical errors; (c) printing errors; (d) late or undelivered mail; (e) errors in the administration of the Fishtoberfest Photo and Video Contest; or (f) injury or damage to persons or property. You waive the right to claim any attorney’s fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
E-SUPPORTER
When you enter or vote, you will automatically be added to the WorldCast Anglers, Jackson Hole Trout Unlimited and Teton Valley Trout Unlimited electronic mailing lists. This includes emails, special event invitations, digital messages and e-newsletters. You may cancel and unsubscribe at any time.
DISPUTES
You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Fishtoberfest Photo and Video Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Wyoming. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Fishtoberfest Planning Committee in connection with the Fishtoberfest Photo and Video Contest, shall be governed by, and construed in accordance with, the laws of Wyoming, without giving effect to any choice of law or conflict of law rules (whether of Wyoming or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Wyoming.
RESULTS
The winners will be announced at Fishtoberfest on October 27th, 2016. We will also post our results on the WorldCast Anglers, Jackson Hole Trout Unlimited and Teton Valley Trout Unlimited’s webpages and social media channels.
